S.F. 2041 Section 1. Section 279.23, subsection 1, Code 2024, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . 0e. If the contract provides for one or more 3 severance payments, a statement that the administrator shall 4 not receive such payments if the contract is terminated as a 5 result of the administrator being found liable in a criminal, 6 civil, or administrative proceeding for which the period for 7 appeal has passed, other than a proceeding regarding a simple 8 misdemeanor or a parking violation as defined in section 9 321.210. 10 Sec. 2. APPLICABILITY. This Act applies to contracts 11 entered into pursuant to section 279.23, or continued pursuant 12 to section 279.24, on or after the effective date of this Act. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill provides that if an employment contract between 17 a school board and an administrator provides for one or more 18 severance payments, the contract shall contain a statement 19 that the administrator shall not receive such payments if 20 the contract is terminated as a result of the administrator 21 being found liable in a criminal, civil, or administrative 22 proceeding for which the period for appeal has passed, other 23 than a proceeding regarding a simple misdemeanor or a parking 24 violation. 25 The bill applies to contracts entered into or continued on or 26 after the effective date of the bill. 27 -1- LSB 5591XS (3) 90 je/jh 1/ 1
