  1  1    Section 1.  Section 153.33, subsection 3, Code 2015, is
  1  2 amended to read as follows:
  1  3    3.  All employees needed to administer this chapter except
  1  4 the executive director shall be appointed pursuant to the merit
  1  5 system.  The executive director shall serve at the pleasure of
  1  6 the board and shall be exempt from the merit system provisions
  1  7 of chapter 8A, subchapter IV. 
  1  8    Sec. 2.  NEW SECTION.  153.33B  Executive director == duties.
  1  9    The board shall appoint a full=time executive director. The
  1 10 executive director shall not be a member of the board. The
  1 11 duties of the executive director shall be the following:
  1 12    1.  To receive all applications for the following:
  1 13    a.  Licensure as a dentist or dental hygienist.
  1 14    b.  Registration as a dental assistant.
  1 15    c.  Permission to administer sedation or anesthesia.
  1 16    d.  Any other activity for which an application to the board
  1 17 is required.
  1 18    2.  To collect and receive all fees.
  1 19    3.  To keep all records pertaining to licensure,
  1 20 registration, enforcement, and other board actions, including a
  1 21 record of all board proceedings.
  1 22    4.  To perform such other duties as may be prescribed by the
  1 23 board.
  1 24    5.  To appoint assistants to the director and other persons
  1 25 necessary to administer this chapter.
  1 26                           EXPLANATION
  1 27 The inclusion of this explanation does not constitute agreement with
  1 28 the explanation's substance by the members of the general assembly.
  1 29    This bill provides for the appointment of an executive
  1 30 director for the dental board. The bill enumerates powers
  1 31 for the executive director consistent with the powers granted
  1 32 to executive directors of other independent health care
  1 33 professional licensing boards such as the board of medicine and
  1 34 the board of nursing. The bill exempts the executive director
  1 35 from the merit system provisions of Code chapter 8A.
