House File 61 - Introduced HOUSE FILE BY BACON A BILL FOR 1 An Act excluding certain poppers and snappers from the 2 definition of fireworks whose sale or use is prohibited. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 1105YH (2) 86 aw/nh PAG LIN 1 1 Section 1. Section 727.2, subsection 1, Code 2015, is 1 2 amended to read as follows: 1 3 1. The term "fireworks" includes any explosive composition, 1 4 or combination of explosive substances, or article prepared 1 5 for the purpose of producing a visible or audible effect 1 6 by combustion, explosion, deflagration, or detonation, and 1 7 includes blank cartridges, firecrackers, torpedoes, skyrockets, 1 8 roman candles, or other fireworks of like construction and 1 9 fireworks containing any explosive or flammable compound, or 1 10 other device containing any explosive substance. The term 1 11 "fireworks" does not include goldstar=producing sparklers on 1 12 wires which contain no magnesium or chlorate or perchlorate, 1 13 flitter sparklers in paper tubes that do not exceed one=eighth 1 14 of an inch in diameter, toy snakes which contain no mercury, 1 15orcaps used in cap pistols, or party poppers, string poppers, 1 16 or snappers, each consisting of not more than twenty=five 1 17 hundredths grains of explosive mixture. 1 18 EXPLANATION 1 19 The inclusion of this explanation does not constitute agreement with 1 20 the explanation's substance by the members of the general assembly. 1 21 This bill excludes party poppers, string poppers, and 1 22 snappers from the definition of fireworks whose sale or use is 1 23 generally prohibited.
