H.F. 59 Section 1. Section 600.8, Code 2023, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 7A. The juvenile court or court may waive 3 any investigation or report required under this section when 4 all of the following criteria are met: 5 a. The person to be adopted is a minor. 6 b. The adoption petitioner was appointed guardian of the 7 minor pursuant to chapter 232D at least three years prior to 8 the filing of the adoption petition. 9 c. The adoption petitioner has undergone the background 10 checks required pursuant to section 232D.307. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill provides that preplacement and postplacement 15 investigations and reports generally required as part of 16 the adoption process may be waived by the juvenile court or 17 court when the person to be adopted is a minor, the adoption 18 petitioner was appointed guardian of the minor at least three 19 years prior to the filing of the adoption petition, and the 20 adoption petitioner has undergone criminal record checks and 21 checks of the child abuse, dependent adult abuse, and sex 22 offender registries in the state as required for all minor 23 guardianships. 24 -1- LSB 1256YH (3) 90 pf/rh 1/ 1
