Section 272.9A, Code 2017, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 4. A superintendent of a school district 1 4 shall not be considered to be in violation of the board's 1 5 standards of professional conduct and ethics if the school 1 6 budget review committee denied the school district's request 1 7 for a modified supplementary amount for a budget year and the 1 8 superintendent approves the school budget and requests the 1 9 school board's authorization for the use of funds from the 1 10 school district's cash reserve in an amount not to exceed the 1 11 district's weighted enrollment multiplied by the difference 1 12 between the school district's regular program district cost per 1 13 pupil and the highest regular program district cost per pupil 1 14 among all school districts in the state. 1 15 Sec. 2. RETROACTIVE APPLICABILITY. This Act applies 1 16 retroactively to actions taken by the superintendent of a 1 17 school district for school budget years beginning on or after 1 18 July 1, 2016. 1 19 EXPLANATION 1 20 The inclusion of this explanation does not constitute agreement with 1 21 the explanation's substance by the members of the general assembly. 1 22 This bill establishes that a superintendent of a school 1 23 district shall not be considered to be in violation of the 1 24 board of educational examiner's standards of professional 1 25 conduct and ethics if the school budget review committee 1 26 denied the district's request for a modified supplementary 1 27 amount for a budget year and the superintendent approves the 1 28 school budget and requests the school board's authorization 1 29 for the use of funds from the school district's cash reserve 1 30 in an amount not to exceed the district's weighted enrollment 1 31 multiplied by the difference between the school district's 1 32 regular program district cost per pupil and the highest regular 1 33 program district cost per pupil among all school districts in 1 34 the state. 1 35 The bill is retroactively applicable to actions taken by the 2 1 superintendent of a school district for school budget years 2 2 beginning on or after July 1, 2016.
