Section
1.
Section
80B.13A,
subsection
5,
Code
2024,
is
1
amended
to
read
as
follows:

5.
Any
All
investigatory
materials,
including
any
3
recommendation,
notification,
or
other
record
or
information
4
provided
by
an
employing
agency
or
the
attorney
general
5
pursuant
to
this
section
shall
be
confidential
except
as
6
required
by
rule
or
order
of
the
council,
an
administrative
law
7
judge,
or
a
reviewing
court.
Any
employing
agency
or
person
8
who,
acting
reasonably
and
in
good
faith,
files
a
notification
9
or
recommendation,
releases
information,
or
otherwise
10
cooperates
with
an
investigation
under
this
section
is
immune
11
from
any
liability,
civil
or
criminal,
which
might
otherwise
12
be
incurred
or
imposed
for
such
action.
If
the
investigative
13
information
in
the
possession
of
the
academy
indicates
a
crime
14
has
been
committed,
the
information
shall
be
reported
to
the
15
proper
law
enforcement
agency.
However,
a
final
written
16
decision
and
finding
of
fact
of
the
council
in
a
disciplinary
17
proceeding
or
an
informal
stipulation
and
settlement
agreement
18
are
public
records.

EXPLANATION
20
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
21
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
revocation
or
suspension
of
the
23
certification
of
a
law
enforcement
officer.
24
The
bill
provides
that
all
investigatory
materials,
25
including
any
recommendation,
notification,
or
other
record
or
26
information
provided
by
an
employing
agency
or
the
attorney
27
general
shall
be
confidential
except
as
required
by
rule
28
or
order
of
the
council,
an
administrative
law
judge,
or
a
29
reviewing
court.
If
the
investigative
information
in
the
30
possession
of
the
academy
indicates
a

has
been

the
