  1  1    Section 1.  Section 28E.2, subsection 2, Code 2018, is
  1  2 amended to read as follows:
  1  3    2.  "Public agency" shall mean any political subdivision of
  1  4 this state; any agency of the state government or of the United
  1  5 States; and any political subdivision of another state; and any
  1  6 federally recognized Indian tribe.
  1  7                           EXPLANATION
  1  8 The inclusion of this explanation does not constitute agreement with
  1  9 the explanation's substance by the members of the general assembly.
  1 10    This bill defines a public agency for purposes of allowing
  1 11 the joint exercise of governmental powers under Code chapter
  1 12 28E to include any federally recognized Indian tribe.  The
  1 13 definition of public agency in Code section 28E.2 is also made
  1 14 applicable to Code chapter 28F concerning the joint financing
  1 15 of public works and facilities, Code section 256B.6 relating
  1 16 to special education, Code section 261I.8 relating to fiscal
  1 17 agents for certain moneys administered by the Early childhood
  1 18 Iowa area board, Code section 455B.301 providing definitions
  1 19 relating to solid waste disposal under the department of
  1 20 natural resources, Code chapter 717F relating to dangerous wild
  1 21 animals, and Code section 904.308 relating to joint use of
  1 22 facilities by the department of corrections.
