  1 An Act relating to conservation and recreation policies and
  2    programs within the department of natural resources.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 455A.4, Code 2018, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  6.  The department is, except as otherwise
  1  4 provided by law, empowered to make and execute agreements,
  1  5 contracts, grants, and other instruments necessary to carry out
  1  6 the department's obligations. The department's obligations
  1  7 shall not be expanded or enlarged by this authority beyond
  1  8 the powers specifically delegated to or conferred upon the
  1  9 department.
  1 10    Sec. 2.  REPEAL.  Chapter 28N, Code 2018, is repealed.
  1 11    Sec. 3.  REPEAL.  Sections 455A.8 and 455A.8A, Code 2018,
  1 12 are repealed.
  1 13                           EXPLANATION
  1 14 The inclusion of this explanation does not constitute agreement with
  1 15 the explanation's substance by the members of the general assembly.
  1 16    This bill changes duties and responsibilities of the
  1 17 department of natural resources.
  1 18    The department currently does not have explicit
  1 19 authorization to make and execute agreements, contracts,
  1 20 grants, and other instruments necessary to carry out the
  1 21 department's obligations. The bill grants the department this
  1 22 authority.
  1 23    Currently, a Mississippi river partnership council provides
  1 24 a forum for stakeholders to discuss matters relevant to the
  1 25 health, management, and use of the Mississippi river. The
  1 26 council has the authority to develop strategies and work with
  1 27 communities, organizations, other states, and federal agencies
  1 28 to further its goals.
  1 29    The department currently contains the Brushy creek
  1 30 recreation trails advisory board that has the purpose of
  1 31 maintaining and improving the trail system within the Brushy
  1 32 creek recreation area and the adjoining state preserve.
  1 33    The bill repeals the Mississippi river partnership council
  1 34 and the Brushy creek recreation trails advisory board.
