Section 724.4B, subsection 2, paragraph a, Code 1 2 2016, is amended to read as follows: 1 3 a. A person listed under section 724.4, subsection 4, 1 4 paragraphs "b" through "f" or "j", or a certified peace officer 1 5 as specified in section 724.6, subsection 1. 1 6 Sec. 2. Section 724.6, subsection 1, Code 2016, is amended 1 7 to read as follows: 1 8 1. A person may be issued a permit to carry weapons when 1 9 the person's employment in a private investigation business 1 10 or private security business licensed under chapter 80A, or a 1 11 person's employment as a peace officer, correctional officer, 1 12 security guard, bank messenger or other person transporting 1 13 property of a value requiring security, or in police work, 1 14 reasonably justifies that person going armed. The permit shall 1 15 be on a form prescribed and published by the commissioner of 1 16 public safety, shall identify the holder, and shall state 1 17 the nature of the employment requiring the holder to go 1 18 armed. A permit so issued, other than to a peace officer, 1 19 shall authorize the person to whom it is issued to go armed 1 20 anywhere in the state, only while engaged in the employment, 1 21 and while going to and from the place of the employment. A 1 22 permit issued to a certified peace officer shall authorize that 1 23 peace officer to go armed anywhere in the state, including a 1 24 school as provided in section 724.4B, at all times. Permits 1 25 shall expire twelve months after the date when issued except 1 26 that permits issued to peace officers and correctional officers 1 27 are valid through the officer's period of employment unless 1 28 otherwise canceled. When the employment is terminated, the 1 29 holder of the permit shall surrender it to the issuing officer 1 30 for cancellation. 1 31 EXPLANATION 1 32 The inclusion of this explanation does not constitute agreement with 1 33 the explanation's substance by the members of the general assembly. 1 34 This bill relates to carrying weapons on school grounds by 1 35 a certified peace officer with a professional permit to carry 2 1 weapons. The bill provides that a certified peace officer 2 2 who possesses a professional permit to carry weapons does not 2 3 commit the criminal violation of unlawfully carrying weapons on 2 4 school grounds under Code section 724.4B. Under current law, a 2 5 peace officer while acting within the official duties of the 2 6 officer may possess a weapon on school grounds. A person who 2 7 commits the offense of unlawfully carrying weapons on school 2 8 grounds commits a class "D" felony. LSB 5881YH (2) 86 jm/lh
