Section
1.
Section
307A.1A,
subsection
1,
Code
2020,
is
1
amended
to
read
as
follows:

1.
There
is
created
a
state
transportation
commission
which
3
shall
consist
of
seven
members,
not
more
than
four
of
whom
4
shall
be
from
the
same
political
party.
The
governor
shall
5
appoint
the
members
of
the
state
transportation
commission
6
for
a
term
of
four
years
beginning
at
12:01
a.m.
on
July
1
7
in
the
year
of
appointment
and
expiring
at
12:00
midnight
on
8
June
30
in
the
year
of
expiration,
subject
to
confirmation
by
9
the
senate.
For
each
of
the
six
districts
of
the
state
as
10
divided
by
the
department
for
purposes
of
the
department’s
11
highway
division
operations,
one
member
shall
be
appointed
to
12
represent,
and
shall
reside
in,
the
district.
One
member
shall
13
be
appointed
to
represent
the
state
and
shall
reside
in
the
14
state.

2.
NEW
SECTION
.
307A.9
Residency
requirement
——

resignation
from
office.

A
member
of
the
commission
appointed
to
represent
the
state
18
or
a
district
of
the
state,
as
described
in
section
307A.1A,
19
who
no
longer
resides
in
the
state
or
the
member’s
district,
20
as
applicable,
shall
be
deemed
to
have
resigned
from
the
21
commission
and
the
vacancy
shall
be
filled
as
described
in
22
section
307A.4.

Sec.
3.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
24
importance,
takes
effect
upon
enactment.
25
Sec.
4.
APPLICABILITY
AND
TRANSITION
PROVISIONS.
This
26
Act
applies
to
members
of
the
state
transportation
commission
27
appointed
and
confirmed
on
or
after
the
effective
date
of
this
28
Act.
The
first
six
regular
term
appointments
to
the
commission
29
made
on
or
after
the
effective
date
of
this
Act
shall
be
for
the
30
six
district
representatives,
as
determined
by
the
governor.
31
The
seventh
regular
term
appointment
to
the
commission
made
32
on
or
after
the
effective
date
of
this
Act
shall
be
for
the
33
representative
of
the
state.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

each
of
the
six
districts
of
the
state
as
divided
by
the

department
of
transportation
(DOT)
for
purposes
of
the
DOT’s
4
highway
division
operations,
this
bill
requires
one
member
5
of
the
state
transportation
commission
(STC)
to
be
appointed
6
to
represent,
and
to
reside
in,
the
district.
The
bill
also
7
requires
one
member
of
the
STC
to
be
appointed
to
represent
the
8
state
and
to
reside
in
the
state.
9
The
bill
provides
that
a
member
appointed
to
represent
the
10
state
or
a
district
who
no
longer
resides
in
the
state
or
the
11
district,
as
applicable,
shall
be
deemed
to
have
resigned
from
12
the
STC
and
the
vacancy
shall
be
filled
as
provided
by
current
13
law.
14
The
bill
takes
effect
upon
enactment,
applies
to
members
of
15
the
STC
appointed
and
confirmed
on
or
after
the
effective
date
16
of
the
bill,
and
sets
forth
transition
provisions.
