1.
NEW
SECTION
.
280.13D
Participation
in
1
extracurricular
interscholastic
athletic
contests
or
competitions
2
provided
by
public
schools
or
nonpublic
schools.

1.
The
board
of
directors
of
a
school
district
shall
allow
4
a
student
who
resides
within
the
school
district
and
who
is
5
enrolled
in
a
nonpublic
school
to
participate
immediately
6
in
any
extracurricular
interscholastic
athletic
contest
or
7
competition
provided
by
the
school
district
pursuant
to
the
8
terms
of
an
agreement
between
the
board
of
directors
of
the
9
school
district
and
the
authorities
in
charge
of
the
nonpublic
10
school
that
provides
for
the
eligibility
of
the
student.

2.
a.
The
authorities
in
charge
of
a
nonpublic
school
12
shall
allow
a
student
who
resides
within
the
school
district
13
where
the
nonpublic
school
is
located
and
who
is
enrolled
14
in
such
school
district
to
participate
immediately
in
any
15
extracurricular
interscholastic
athletic
contest
or
competition
16
provided
by
the
nonpublic
school
pursuant
to
the
terms
of
an
17
agreement
between
the
authorities
in
charge
of
the
nonpublic
18
school
and
the
board
of
directors
of
the
school
district
that
19
provides
for
the
eligibility
of
the
student.

b.
The
authorities
in
charge
of
a
nonpublic
school
may
21
establish
a
reasonable
fee
for
the
cost
of
a
student’s
22
participation
in
an
extracurricular
interscholastic
athletic
23
contest
or
competition
pursuant
to
paragraph
“a”
.
The
student,
24
or
the
student’s
parent
or
guardian,
shall
be
responsible
for
25
the
payment
of
such
fee.

3.
An
organization,
as
defined
in
section
280.13,
shall
not
27
take
into
account
the
number
of
students
who
participate
in
an
28
extracurricular
interscholastic
athletic
contest
or
competition
29
provided
by
a
school
district
or
a
nonpublic
school
pursuant
to
30
this
section
when
determining
the
classification
of
a
public
31
school
or
a
nonpublic
school.

4.
A
student
who
participates
in
an
extracurricular

interscholastic
athletic
contest
or
competition
pursuant

to
this
section
shall
be
deemed
to
satisfy
the
residence

This
bill
relates
to
the
eligibility
of
students

enrolled
in
public
schools

nonpublic
schools
to
compete

interscholastic
athletic
contests
or

competitions
provided
by
other
public
schools
or
nonpublic

schools.

The
bill
requires
school
districts
to
allow
a
student
10
who
resides
within
the
school
district
and
who
is
enrolled
11
in
a
nonpublic
school
to
participate
immediately
in
any
12
extracurricular
interscholastic
athletic
contest
or
competition
13
provided
by
the
school
district
pursuant
to
the
terms
of
an
14
agreement
between
the
school
district
and
the
nonpublic
school
15
that
provides
for
the
eligibility
of
the
student.

The
bill
also
requires
nonpublic
schools
to
allow
a
17
student
who
resides
within
the
school
district
where
the
18
nonpublic
school
is
located
and
who
is
enrolled
in
such
school
19
district
to
participate
immediately
in
any
extracurricular
20
interscholastic
athletic
contest
or
competition
provided
by
the
21
nonpublic
school
pursuant
to
the
terms
of
an
agreement
between
22
the
nonpublic
school
and
the
school
district
that
provides
for
23
the
eligibility
of
the
student.
The
bill
authorizes
nonpublic
24
schools
to
establish
a
reasonable
fee
for
the
cost
of
a
25
student’s
participation
in
such
extracurricular
interscholastic
26
athletic
contest
or
competition.
The
bill
provides
that
the
27
student,
or
the
student’s
parent
or
guardian,
is
responsible
28
for
the
payment
of
the
fee.
29
The
bill
establishes
that
a
student
who
participates
in
an
30
extracurricular
interscholastic
athletic
contest
or
competition
31
pursuant
to
these
provisions
shall
be
deemed
to
satisfy
32
the
residence
requirements
of
Code
section
256.46
(rules
33
for
participation
in
extracurricular
activities
by
certain
34
children).

The
bill
prohibits
an
organization,
as
defined
in
Code
1
section
280.13
(requirements
for
interscholastic
athletic
2
contests
and
competitions),
from
taking
into
account
the
3
number
of
students
who
participate
in
an
extracurricular
4
interscholastic
athletic
contest
or
competition
pursuant
to
5
these
provisions
when
determining
the
classification
of
a
6
public
school
or
a
nonpublic
school.
