1.
NEW
SECTION
.
461A.10A
Restrictions
on
acquiring
1
real
property.

1.
The
department
shall
not
acquire
real
property
available
3
for
sale
at
an
auction
for
real
property.
The
department
4
shall
only
acquire
real
property
from
a
willing
donor
or
5
willing
seller,
who
shall
not
be
under
any
compulsion
by
the
6
department.
The
department
shall
not
acquire
real
property
by
7
donation
or
purchase
from
a
nonprofit
corporation
that
acquired
8
the
real
property
in
a
competitive
manner,
including
but
not
9
limited
to
at
an
auction.

2.
For
purposes
of
this
section,
“auction”
means
a
public
11
auction
or
private
auction,
including
but
not
limited
to
an
12
auction
by
electronic
means,
an
auction
by
sealed
bid,
or
a
13
conventional
oral
auction.

Sec.
2.
Section
461A.11,
subsection
1,
Code
2024,
is
amended
15
to
read
as
follows:

1.
The
commission
may
accept
gifts
of
land
or
other
17
property,
subject
to
section
461A.10,
or
the
use
of
lands
or
18
other
property
for
a
term
of
years,
and
improve
and
use
the
19
land
as
public
state
parks.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
restricts
the
acquisition
of
real
property
by
the
24
department
of
natural
resources
(DNR).
The
bill
authorizes
DNR
25
to
only
acquire
property
through
willing
donors
and
sellers,
26
who
shall
not
be
under
the
compulsion
of
DNR.
DNR
also
shall
27
not
acquire
property
from
a
nonprofit
that
acquired
property
in
28
a
competitive
manner,
including
at
an
auction.
