Section
1.
Section
306.8,
subsection
1,
Code
2020,
is
1
amended
to
read
as
follows:
2
1.
a.
Prior
to
a
change
in
jurisdiction
of
a
road
or
3
street,
the
unit
of
government
having
jurisdiction
shall
either
4
place
the
road
or
street
and
any
structures
on
the
road
or
5
street
in
good
repair
or
provide
for
the
transfer
of
money
to
6
the
appropriate
jurisdiction
in
an
amount
sufficient
for
the
7
repairs
to
the
road
or
street
and
any
structures
on
the
road
or
8
street.

b.
Prior
to
a
change
in
jurisdiction
of
a
road
or
street
10
from
the
department
to
a
county
board
of
supervisors,
the
road
11
or
street
shall
be
resurfaced
by
the
department
if
the
road
or
12
street
has
not
been
resurfaced
within
the
previous
five
years
13
from
the
date
of
transfer,
and
all
bridges
that
are
part
of
14
the
transfer
shall
pass
an
inspection
by
the
department
in
15
accordance
with
the
national
bridge
inspection
standards.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
18
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
law
allows
transfers
of
jurisdiction
and
control
20
of
roads
and
streets
if
there
is
an
agreement
between
the
21
jurisdictions
of
government
involved.
Prior
to
a
change
in
22
jurisdiction
of
a
road
or
street,
the
unit
of
government
23
having
jurisdiction
must
either
place
the
road
or
street
24
and
structures
thereon
in
good
repair
or
provide
for
the
25
transfer
of
money
to
the
appropriate
jurisdiction
in
an
amount
26
sufficient
for
the
necessary
repairs
to
the
road
or
street
and
27
structures
thereon.

This
bill
provides
that
prior
to
the
department
of
29
transportation
(DOT)
transferring
jurisdiction
of
a
road
or
30
street
to
a
county
board
of
supervisors,
the
road
or
street
31
must
be
resurfaced
by
the
DOT
if
the
road
or
street
has
not
32
been
resurfaced
within
the
previous
five
years
from
the
date
33
of
transfer,
and
all
bridges
that
are
part
of
the
transfer
34
must
pass
an
inspection
by
the
DOT
in
accordance
with
national
