Section
1.
Section
514C.28,
subsection
2,
paragraph
b,
Code
1
2014,
is
amended
to
read
as
follows:

b.
“Autism
service
provider”
means
a
person,
entity,
or
3
group
providing
that
designs,
supervises,
or
provides
treatment
4
of
autism
spectrum
disorders.
An
autism
service
provider
that
5
designs,
supervises,
or
provides
treatment
of
autism
spectrum
6
disorders
that
includes
applied
behavioral
analysis
shall
7
be
certified
as
a
behavior
analyst
by
the
behavior
analyst
8
certification
board
or
shall
be
a
health
professional
licensed
9
under
chapter
147
or
shall
be
certified
as
a
behavior
analyst,
10
or
certified
as
an
assistant
behavior
analyst
working
under
the
11
supervision
of
a
certified
behavior
analyst,
by
the
behavior
12
analyst
certification
board.
A
certified
assistant
behavior
13
analyst
who
works
under
the
supervision
of
a
certified
behavior
14
analyst
may
implement
components
of
a
treatment
plan
that
15
include
applied
behavior
analysis
.

Sec.
2.
APPLICABILITY.
This
Act
applies
to
plans
17
established
pursuant
to
chapter
509A
for
employees
of
the
state
18
that
are
delivered,
issued
for
delivery,
continued,
or
renewed
19
in
this
state
on
or
after
January
1,
2015.

EXPLANATION
21
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
amends
Code
section
514C.28
which
provides
autism
24
spectrum
disorders
coverage
to
certain
persons
under
21
years
25
of
age
that
are
covered
under
group
health
insurance
plans
26
established
for
state
employees.
27
The
bill
provides
that
an
autism
service
provider
includes
28
an
entity
as
well
as
a
person
or
group,
that
designs
or
29
supervises,
as
well
as
provides
treatment
of
autism
spectrum
30
disorders.
The
bill
provides
that
an
autism
service
provider
31
that
designs,
supervises,
or
provides
treatment
of
autism
32
spectrum
disorders
that
includes
applied
behavioral
analysis
33
must
be
certified
as
a
behavior
analyst
by
the
behavior
34
analyst
certification
board.
The
bill
also
provides
that
an
