SENATE RESOLUTION

 

 

requesting the department of transportation to conduct a study of personal vehicle rental organizations.

 

 


     WHEREAS, public modes of transportation have transformed over the years from traditional taxi services to individuals using their personal vehicles for transportation services via a transportation network company; and

 

     WHEREAS, a new mode of transportation has recently developed where private individuals are renting their personal vehicles to other individuals as a commercial enterprise via a third party web-based platform; and

 

     WHEREAS, up to one hundred fifty personal vehicles are available for rent, ranging from $30 to $350 per day, in the State; and

 

     WHEREAS, in many cases, these personal vehicles are being rented to visitors and residents without any regulation, resulting in a loss of revenue to the State; and

 

     WHEREAS, renting personal vehicles on a fee basis via a third party web-based platform is currently unregulated and as such, there are no regulations in place to ensure that vehicles are being rented to qualified individuals and have adequate insurance coverage, and that vehicle safety standards are met; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, that the Department of Transportation is requested to convene a working group to evaluate the regulation of personal vehicle rentals and consider practice standards for this industry to ensure the safety of the public; and

 

     BE IT FURTHER RESOLVED that the Director of Transportation is requested to serve as the chair of the working group and to invite the following individuals to serve as members of the working group:

 

     (1)  The Insurance Commissioner or the Commissioner's designee;

 

     (2)  The Executive Director of the Office of Consumer Protection or the Director's designee;

 

     (3)  One representative from the Department of Transportation;

 

     (4)  Two representatives from the motor vehicle rental industry conducting business in the State; and

 

     (5)  Two representatives from the licensed automobile insurance industry conducting business in the State; and

 

     BE IT FURTHER RESOLVED that the working group is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2020; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Transportation, Insurance Commissioner, and Executive Director of the Office of Consumer Protection.
