A BILL FOR AN ACT

 

 

RELATING TO WILDLIFE MANAGEMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that in 2022, the State received over $10,000,000 in federal money from the Wildlife and Sport Fish Restoration program, also known as the Pittman-Robertson Dingell-Johnson/Wallop-Breaux program.  The purpose of the funds is to support sustainable fishing and hunting and wildlife conservation throughout the Hawaiian islands.  The legislature further finds that in order to better support local fishers, oversight of the funds' expenditures is needed.

     Accordingly, the purpose of this Act is to require the department of land and natural resources' division of aquatic resources to submit an annual report to the legislature, beginning in 2025, summarizing the division's expenditure of funds received from the Wildlife and Sport Fish Restoration program for the preceding year.

     SECTION 2.  Section 187A-9, Hawaii Revised Statutes, is amended to read as follows:

     "§187A-9  Federal aid in sport fish restoration.  (a)  The State hereby assents to the provisions of the Federal Aid in Sport Fish Restoration (Dingell-Johnson/Wallop-Breaux) Act (64 Stat. 430, 16 U.S.C. §777), as amended.  The department shall perform those acts as may be necessary to the conduct and establishment of cooperative aquatic life restoration, management, development, aquatic education, and recreational boating access projects, as defined in the Act of Congress and in compliance with the Act and regulations adopted by the Secretary of the Interior thereunder; provided that federal aid funds granted under the Act shall be used for the purposes of approved projects, and no funds accruing to the State from license fees paid by sport fishers, including any interest, dividend, or other income earned from the license fees, shall be diverted for any purpose other than as provided for in the Act and regulations adopted pursuant thereto.

     (b)  The division of aquatic resources shall submit an annual report to the legislature no later than twenty days prior to the convening of the regular session of 2025 and each regular session thereafter summarizing the division's expenditure of funds received from the Wildlife and Sport Fish Restoration program for the preceding year and providing the recipient and purpose of each expenditure."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.
