A BILL FOR AN ACT

 

 

relating to flags.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 421J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§421J-    Display of American flags.  (a)  An association shall allow the display of an American flag on all detached single-family residential units and on all single-story attached residential units subject to the following restrictions:

     (1)  Flags shall be no larger than four feet by six feet;

     (2)  Flags shall be mounted on an exterior wall of the unit within five feet of the main entrance or garage door;

     (3)  Mounting hardware shall be set at an angle of between thirty and eighty degrees;

     (4)  The highest point of the mounting hardware shall be no higher than ten feet from ground level; and

     (5)  Flags shall not be mounted on a free-standing flag pole; provided that an association may, by rule, authorize the display of flags on flag poles, subject to conditions and limitations.

     (b)  An association shall not charge a fee or require any approval process for the display of mounted flags pursuant to this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2011.
