A BILL FOR AN ACT

 

 

Relating to transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the realignment of Farrington highway in the Makaha beach area of Oahu is necessary to address public safety and traffic concerns.  The Makaha beach area faces many of the same environmental stressors faced by Laniakea beach on the North Shore of Oahu.  During the regular session of 2014, Senate Bill No. 3035 was introduced to address the pedestrian safety, seasonal erosion, and sea level change concerns in that area by realigning Kamehameha highway.  At times, high surf in the Makaha beach area along Farrington highway crosses the roadway, rendering it impassable.  As recently as 2008, the road has flooded to a depth of two feet.  Such conditions cause inconvenience to residents and impede emergency services.  Seasonal beach erosion frequently threatens the existing highway roadbed fronting the Makaha surf break, exposing boulders and concrete, as well as creating public safety concerns.  Realigning Farrington highway in the Makaha beach area would effectively address the environmental concerns of erosion and sea level rise.

     Additionally, pedestrian traffic crossing Farrington highway in the Makaha beach area is a public safety issue.  Similar to the frequent crossings of Kamehameha highway near Laniakea beach, the Makaha Beach Park comfort station and a canoe halau are across the highway from the beach, requiring frequent pedestrian crossings of Farrington highway.  Realignment of Farrington highway will address the pedestrian safety concerns in the Makaha beach area by reducing pedestrian crossings of the highway.

     The purpose of this Act is to authorize the issuance of general obligation bonds and appropriate funds to the department of transportation to realign Farrington highway mauka in the Makaha beach area of Oahu.

     SECTION 2.  The department of transportation shall make plans to realign Farrington highway mauka of the Makaha beach area of Oahu; provided that the realignment, if necessary, shall be resilient and adaptive to rising sea levels and coastal erosion as a result of climate change.

     SECTION 3.  The director of finance is authorized to issue general obligation bonds in the sum of $           or so much thereof as may be necessary and the same sum or so much thereof as may be necessary is appropriated for fiscal year 2015-2016 for the purpose of planning for and realigning Farrington highway mauka of the Makaha beach area of Oahu.

     SECTION 4.  The appropriation made for the capital improvement project authorized by this Act shall not lapse at the end of the fiscal biennium for which the appropriation is made; provided that all moneys from the appropriation unencumbered as of June 30, 2018, shall lapse as of that date.

     SECTION 5.  This Act shall take effect on July 1, 2015.
