A BILL FOR AN ACT

 

 

relating to intoxicating liquor.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 281, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§281‑    Server or seller certification.  (a)  The liquor commission of each county may prohibit any person from working as a server or seller at a licensed premise in the county unless the person is certified by the liquor commission as a server or seller.

     (b)  The liquor commission of each county may adopt rules to develop and offer a certification program, either alone or in conjunction with the liquor commission of any other county, to provide training for persons to work as servers or sellers at licensed premises within the respective county; provided that the county liquor commissions may provide for reciprocity arrangements among the liquor commissions of the several counties.

     (c)  The requirements of subsection (a) shall not apply to employees who are not servers or sellers for whom occasional deliveries of unopened bottles of beer, wine, or liquor are merely incidental to the employee's job duties or to those employees who are not servers or sellers and whose job duties include replenishing the contents of minibars."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.

Authorizes the county liquor commissions to require training and certification for liquor servers or sellers; exempts employees whose job duties involve only incidental contact with liquor.  (SD1).
