A BILL FOR AN ACT

 

 

RELATING TO CAMPAIGN FINANCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that public awareness has increased remarkably concerning candidate committee contributions and expenditures that might have arisen principally due to legislative functions carried out during a special session of the legislature.

     The purpose of this Act is to provide additional public disclosure by requiring an additional and better-timed supplemental report by legislators in the event one or both houses of the legislature convene in a special session for any purpose.  It is not the intention of the legislature, however, to require any supplemental reports from legislators if their respective house did not hold a special session or from a legislator who did not receive any contributions during the special session.

     SECTION 2.  Section 11-334, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The candidate and treasurer of the candidate committee of each candidate whose name will appear on the ballot in the immediately succeeding election shall file preliminary, final, and supplemental reports.

     (1)  The filing dates for preliminary reports are:

         (A)  Thirty calendar days prior to a primary election;

         (B)  Ten calendar days prior to a primary, each special, or each nonpartisan election; and

         (C)  Ten calendar days prior to a general election; provided that this preliminary report does not need to be filed by a candidate who is unsuccessful in a primary, special, or nonpartisan election, or a candidate who is elected to office in the primary, initial special, or initial nonpartisan election.

          The preliminary report filed by the date required under subparagraph (A) shall be current through June 30, and all other preliminary reports shall be current through the fifth calendar day before the filing deadline of those other preliminary reports.

     (2)  The filing date for the final primary report is twenty calendar days after a primary, initial special, or initial nonpartisan election.  The report shall be current through the day of the applicable election.

     (3)  The filing date for the final election period report is thirty calendar days after a general, subsequent, subsequent special, or subsequent nonpartisan election.  The report shall be current through the day of the applicable election.  The final election period report shall be filed by a candidate who is unsuccessful in a primary, initial special, or initial nonpartisan election or a candidate who is elected to office in the primary, initial special, or initial nonpartisan election.

     (4)  The filing dates for supplemental reports are:

         (A)  January 31 after an election year; and

         (B)  July 31 after an election year.

          The report shall be current through December 31 for the report filed on January 31 and current through June 30 for the report filed on July 31[.], and does not need to include any information that was previously reported on a supplemental report of a special session pursuant to paragraph (5) by the person filing this report.

     (5)  The filing date for supplemental reports of a special session convened by one or both houses of the legislature is thirty days after the conclusion of that special session; provided that a special session supplemental report shall be filed only if the next regularly scheduled report required by this section is due more than ninety calendar days after conclusion of that special session; provided further that special session supplemental reports are required only from legislators who received contributions during the special session and were members of a house that convened in special session.  The report shall be current from the last reporting period through the conclusion of the special session.  The report is in addition to any other reports that are required to be filed by this part, however, any information reported in a supplemental report for a special session does not need to be included in any subsequent reports."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on its approval.
