A BILL FOR AN ACT
relating to digital identification.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§286- Digital identification; pilot program. (a) The director shall establish and implement a pilot program for the issuance of digital identification to be administered by the examiner of drivers for each county.
(b) In establishing the digital identification
pilot program, the director shall:
(1) Assess existing
infrastructure and identify changes required to implement the program;
(2) Upgrade
infrastructure according to the director's findings under paragraph (1);
(3) Acquire or
develop a mobile application that:
(A) Displays
digital identification that includes all information required under this
chapter;
(B) Includes
an authentication and verification process for a wireless communication device;
and
(C) May
be used in any location regardless of the location's level of wireless
connectivity or cellular telephone service;
(4) Deploy the
digital identification mobile application at no cost to focus groups for testing
and evaluation; and
(5) Implement a law
enforcement version of the application for field testing.
(c) Digital identification issued under this
section shall not be used or accepted as valid proof of identification for
purposes of compliance with the REAL ID Act of 2005.
(d) The director may contract with a third party
to establish the pilot program and implement the department's recommendations.
(e) The director shall submit a report of
findings and recommendations, including any proposed legislation, to the
legislature no later than twenty days prior to the convening of the regular
session of 2022.
(f) For purposes of this section:
"Department"
means the department of transportation.
"Digital identification" includes driver's licenses and civil identification cards in digital format."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2021, and shall be repealed on June 30, 2022.
