A BILL FOR AN ACT

 

 

relating to sex offenders.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 712, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§712-    Sex offenders; prohibited employment or volunteer work.  (1)  No person who is required to register under section 846E-2 shall be an employer, employee, or independent contractor, or act as a volunteer with any person, group, company, or organization in a capacity in which the registrant would be working directly and in an unaccompanied setting with a minor on more than an incidental and occasional basis or have supervision or disciplinary power over a minor.

     (2)  For purposes of this section, "working directly and in an unaccompanied setting" includes but is not limited to providing goods or services to minors.

     (3)  A violation of this section is a misdemeanor."

     SECTION 2.  Chapter 846E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§846E-    Disclosure requirements.  (a)  Every person required to register under section 846E-2 who applies for or accepts a position as an employee or volunteer with any person, group, or organization where the registrant would be working directly and in an unaccompanied setting with a minor on more than an incidental and occasional basis or have supervision or disciplinary power over a minor, shall disclose the person's status as a registrant, upon application or acceptance of a position, to that person, group, or organization.

     (b)  For purposes of this section, "working directly and in an unaccompanied setting" includes but is not limited to providing goods or services to minors.

     (c)  A violation of this section is a misdemeanor."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.

Description:

Requires disclosure by registered sex offenders upon application or acceptance of a position involving certain association with minors.  Prohibits registered sex offenders from being employed or volunteering in a capacity where the registered sex offender would be working directly and in an unaccompanied setting with minors on more than an incidental and occasional basis or have supervision or disciplinary power over minors.
