A BILL FOR AN ACT

 

 

RELATING TO CORRECTIONAL FACILITIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 353C, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§353C‑    Correctional facility and community correctional center deaths; reporting.  (a)  The director shall report to the senate president, speaker of the house of representatives, and legislative committee chairs having primary responsibility for public safety issues, the death of:

     (1)  Correctional facility or community correctional center employees who die on the grounds of a correctional facility or community correctional center where Hawaii inmates reside or who sustain an injury on the grounds of a correctional facility or community correctional center where Hawaii inmates reside that causes the death of the employee; and

     (2)  Any Hawaii inmate who is incarcerated in a correctional facility or community correctional center,

within twenty-four hours of the death.

     (b)  The report in subsection (a) shall include the following information:

     (1)  The name of the decedent;

     (2)  Whether the decedent is an inmate or employee;

     (3)  The location of the death or injury leading to the death;

     (4)  The date and time of the death; and

     (5)  The cause of death;

provided that if the cause of death has not been officially determined, the director shall provide notice of the official cause of death as required by this section within forty-eight hours of receipt of that information.

     (c)  The director shall have the discretion to withhold disclosure of the decedent's name pending notification of the death to the next of kin or if the decedent's identity is protected from disclosure by state or federal laws."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2020.

Description:

Requires the Department of Public Safety to report to the legislature any inmate or correctional facility employee death within forty-eight hours.  Effective July 1, 2020.  (SB49 HD1)
