A BILL FOR AN ACT

 

 

RELATING TO ALTERNATIVE SCHOOLS FOR JUVENILES INVOLVED IN THE JUSTICE SYSTEM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 to the department of education to establish and maintain an alternative school in the leeward school district of Oahu, to provide ongoing education to juveniles involved in the justice system or at high risk of involvement in the justice system.

     The alternative school shall be an off-campus alternative learning center modeled after the high core program in the central school district of Oahu.  Funds appropriated by this Act may be used for utilities, curriculum, equipment, and supplies, and the hiring of necessary staff.

     The alternative school shall service at-risk students from all secondary schools in the leeward school district who are referred by their home schools after all school level resources have been utilized.  The alternative school shall offer a variety of programs to meet the particular needs of its students, including but not limited to full-time programs, before- and after-school programs, and twilight school programs.  A student may be considered for the alternative school if the student:

     (1)  Has ten or more unauthorized absences during the current or previous quarter;

     (2)  Academically failed two or more courses during the current or previous quarter;

     (3)  Has three of more disciplinary referrals classified as A, B, C, or D offenses under chapter 19, Hawaii Administrative Rules;

     (4)  Is one or more grade levels behind;

     (5)  Has a case that has been adjudicated under the juvenile justice system or is otherwise involved with the juvenile justice system; or

     (6)  Demonstrates other at-risk factors as determined by the home school.

     The sum appropriated shall be expended by the department of education for the purposes of this Act.
