A BILL FOR AN ACT

 

 

relating to contractors.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to:

     (1)  Require a general building contractor on construction projects involving more than four unrelated building trades or crafts; and

     (2)  Authorize a specialty contractor to take and execute a construction contract involving two or more crafts or trades without requiring the performance of the work to be incidental and supplemental.

     SECTION 2.  Section 444-7, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  A general building contractor is a contractor whose principal contracting business is in connection with any structure built, being built, or to be built, for the support, shelter, and enclosure of persons, animals, chattels, or movable property of any kind, requiring in its construction the use of more than [two] four unrelated building trades or crafts, or to do or superintend the whole or any part thereof."

     SECTION 3.  Section 444-8, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  This section shall not prohibit a specialty contractor from taking and executing a contract involving the use of two or more crafts or trades[, if the performance of the work in the crafts or trades, other than in which the specialty contractor is licensed, is incidental and supplemental to the performance of work in the craft for which the specialty contractor is licensed]."

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
