A BILL FOR AN ACT

 

 

relating to GOVERNMENT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature believes that Hawaii would benefit from a reorganization of the State's health delivery, public health, environmental management, and environmental protection functions.  Transferring responsibility for certain health delivery services from the department of health to the department of human services would allow the department of health to operate more efficiently and to prioritize its administrative roles.  It would also provide a dedicated department for environmental protection and environmental management, including water resource management and environmental permitting.  Currently, these functions are divided among many different state departments.

     The legislature recognizes that effecting this change will require the amendment, reorganization, and reassignment of a large number of administrative rules, statutory provisions, spending authorities, and other functions.

     Accordingly, the purpose of this Act is to require the office of the attorney general to make a comprehensive plan for:

     (1)  Re-designating the department of health as the department of environmental protection and public health; and

     (2)  Transferring responsibility for certain health delivery services from the department of health to the department of human services.

     SECTION 2.  (a)  The office of the attorney general shall identify all administrative rules, statutory provisions, accounts, special funds, and other legal provisions that require amendment to:

     (1)  Re-designate the department of health as the department of environmental protection and public health; and

     (2)  Transfer from the department of health to the department of human services all responsibilities, services, and accounts associated with:

          (A)  The behavioral health services administration; and

          (B)  The family health services division.

     (b)  The office of the attorney general shall submit a report of its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2025.

     SECTION 3.  This Act shall take effect upon its approval.
