A BILL FOR AN ACT

 

 

relating to consumer protection.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 453, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§453-    Prescription of narcotic drugs.  (a)  Notwithstanding any law to the contrary, no person licensed pursuant to this chapter shall issue a prescription for a narcotic drug for more than a thirty-day supply, and no prescription issued pursuant to this section shall be refilled automatically.

     (b)  For purposes of this section, "narcotic drug" means any drug or substance covered by schedules II and III of title 21 United States Code section 812."

     SECTION 2.  Chapter 463E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§463E-    Prescription of narcotic drugs.  (a)  Notwithstanding any law to the contrary, no person licensed pursuant to this chapter shall issue a prescription for a narcotic drug for more than a thirty-day supply, and no prescription issued pursuant to this section shall be refilled automatically.

     (b)  For purposes of this section, "narcotic drug" means any drug or substance covered by schedules II and III of title 21 United States Code section 812."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2014.
