A BILL FOR AN ACT

 

 

RELATING TO CROP DAMAGE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the agricultural industry is a key component in Hawaii's quest for food security.  Damage to agricultural crops by the Hawaiian coot, moorhen, nene goose, stilt, and duck has increased significantly in certain locations in the State and is harming the livelihood of farmers.  Balancing agricultural productivity and the preservation of Hawaii's wildlife is critical to the economic and environmental well-being of the State.  Monitoring the status of the recovery efforts of these species, among other things, is essential in striking the appropriate economic and environmental balance.

     The purpose of this Act is to require the department of land and natural resources to monitor and analyze the status of the Hawaiian coot, moorhen, nene goose, stilt, and duck with respect to their interaction with agricultural practice and publish the results annually on the department's website.

     SECTION 2.  Chapter 195D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§195D-    Hawaiian coot, moorhen, nene goose, stilt, and duck; research; annual report.  (a)  The department shall research, monitor, survey, and analyze the Hawaiian coot (Fulica alai), Hawaiian moorhen (Gallinula galeata sandvicensis), Hawaiian nene goose (Branta sandvicensis), Hawaiian stilt (Himantopus mexicanus knudseni), and Hawaiian duck (Anas wyvilliana) with respect to their interaction with agricultural practices, including for each species:

     (1)  Current population and projection;

     (2)  Habitat sites statewide;

     (3)  Breeding seasons;

     (4)  Feeding habits statewide; and

     (5)  Destruction of agricultural products.

     (b)  The duties of the department under subsection (a) shall include requesting, receiving, and analyzing relevant information from the United States Fish and Wildlife Service.  The information and analysis shall be included in the department's annual report as provided in subsection (c).

     (c)  The department shall annually publish on its website the results of its research, including recommendations and best practices, in a manner and in a format that assists the agricultural industry in interacting with each specified species in an economically and environmentally sound manner."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2016-2017 for the department of land and natural resources to research, monitor, survey, and analyze the Hawaiian coot, Hawaiian moorhen, Hawaiian nene goose, Hawaiian stilt, and Hawaiian duck with respect to their interaction with agricultural practices and annually publish the information on its website.

     The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2050.
