A BILL FOR AN ACT
RELATING TO HEALTH.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 329, Hawaii Revised Statutes, is amended by adding two new sections to part I to be appropriately designated and to read as follows:
"§329-A Narcotics enforcement and prescription drug monitoring advisory committee; established. (a) There is established a narcotics enforcement and prescription drug monitoring advisory committee within the department of public safety for administrative purposes. The committee shall be composed of five members appointed by the governor in accordance with section 26-34. Of the five members:
(1) One member shall be a physician licensed in accordance with chapter 453, specializing in pain medicine;
(2) One member shall be a physician licensed in accordance with chapter 453, specializing in family medicine;
(3) One member shall be a physician licensed in accordance with chapter 453, specializing in internal medicine;
(4) One member shall be a physician licensed in accordance with chapter 453 or a psychologist licensed in accordance with chapter 465, specializing in substance use and addiction; and
(5) One member shall be a registered pharmacist, as defined in section 461-1.
(b) All members shall serve for a term of four years. Any vacancies occurring in the membership of the committee shall be filled for the remainder of the unexpired term in the same manner as the original appointments.
(c) The purpose of the narcotics enforcement and prescription drug monitoring advisory committee shall be to advise and assist the department of public safety narcotics enforcement division by:
(1) Monitoring and reviewing statewide statistics regarding drug prescriptions, including patient and provider information;
(2) Identifying the top twenty per cent of all drug prescribers based on the number of prescription drugs prescribed and the total number of pills dispensed;
(3) Ascertaining whether the State has met community standards of care and specialty standards of care and coordinating with the state medical board if there has been a deviation from standards of care; and
(4) Providing recommendations regarding state-designated pain programs, opioid-use policy, continuing medical education requirements concerning drug prescriptions, utilization of pain medication agreements between patients and prescribers, strengthening the electronic prescription accountability system, and the Hawaii drug take-back and education initiative program established in section 329-B.
§329-B Hawaii drug take-back and education initiative; established. There shall be established within the department of public safety the Hawaii drug take-back and education initiative. The objectives of the Hawaii drug take-back and education initiative shall include the following:
(1) Organization of the safe return and disposal of drugs through a drug take-back event, which shall meet the requirements of federal law, each quarter;
(2) Development of strategic partnership recommendations to incentivize the return and disposal of drugs;
(3) Initiatives, in collaboration with the department of health and the narcotics enforcement and prescription drug monitoring advisory committee, to expand and coordinate education programs, partnerships, and federal grants; and
(4) Integration of recommendations from the narcotics enforcement and prescription drug monitoring advisory committee established in section 329-A."
SECTION 2. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2015.
