A BILL FOR AN ACT

RELATING TO RECYCLING.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that S.C.R. No. 74, S.D. 1, H.D. 1, regular session of 2014, requested the office of the auditor to conduct an audit of the department of health's advance disposal fee program. In response, the office of the auditor released Report No. 14-17 in December of 2014, which recommended that the department of health:

(1) Consider combining the advance disposal fee and deposit beverage container glass processing streams to increase efficiency and decrease costs while increasing the supply of glass available for down-cycling;

(2) Update and finalize the 2008 department of health draft policy on glass recycling dated July 1, 2008, to:

(A) Equally allow recycling or down-cycling;

(B) Clearly allow stockpiling of glass for the purposes of maintaining inventory;

(C) Include a complete list of approved down-cycling options to allow recyclers more flexibility in marketing their product; and

(D) Allow the use of glass as alternative daily cover in the down-cycling options;

(3) Work with stakeholders to make practical policies and rules governing the stockpiling of processed glass; and

(4) Increase the recovery rate for advance disposal fee glass containers to seventy-five per cent, which is approximately the same redemption rate that the deposit beverage container program has achieved, through increased funding of the "buy back" program and an increase in the advance disposal fee rate.

The purpose of this Act is to mandate the department of health to adopt and implement the recommendations made by the auditor.

SECTION 2. The department of health shall:

(1) Perform a cost-benefit analysis of and consider combining the glass processing streams for advance disposal fee glass containers under chapter 342G, part VII, Hawaii Revised Statutes, and deposit beverage containers under chapter 342G, part VIII, Hawaii Revised Statutes;

(2) Update the 2008 department of health draft policy on glass recycling dated July 1, 2008. The updated policy shall:

(A) Equally allow recycling or down-cycling;

(B) Clearly allow stockpiling of glass for the purposes of maintaining inventory;

(D) Allow the use of glass as an alternative daily cover in the down-cycling options;

(3) Work with stakeholders to make practical policies and rules governing the stockpiling of processed glass; and

(4) Increase the recovery rate for advance disposal fee glass containers to seventy-five per cent.

SECTION 3. The department of health shall submit a report to the legislature no later than twenty days prior to the convening of the 2019 regular session. The report shall include:

(1) All findings and recommendations, including any proposed legislation, with regard to combining the advance disposal fee glass container and deposit beverage container glass processing streams;

(2) The updated policy of the 2008 department of health draft policy on glass recycling dated July 1, 2008;

(3) All new policies and rules governing the stockpiling of processed glass; and

(4) Plans to increase the recovery rate for advance disposal fee glass containers to seventy-five per cent.

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to conduct a cost-benefit analysis of combining the glass processing streams for advance disposal fee glass containers and deposit beverage containers.

The sums appropriated shall be expended by the department of health for the purposes of this Act.

SECTION 5. This Act shall take effect on June 1, 2050.

Appropriates funds to the department of health to conduct a cost-benefit analysis of combining the glass processing streams of the advance disposal fee glass containers and deposit beverage containers.
