A BILL FOR AN ACT

 

 

Relating to The Internet.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the Internet Corporation of Assigned Names and Numbers is expanding the realm of generic top-level domains, such as .com, .gov, and .org, to include new domains.  The application window for new generic top-level domains opened on January 12, 2012, and closes on April 12, 2012.  The fee for an application for a domain is $185,000 while the annual expense affiliated with a domain is $165,000.  It is imperative for the State of Hawaii to claim the .hawaii, .hi, and .aloha domains to prevent the misappropriation of those domains and potential damage to the State's reputation. 

     The purpose of this Act is to:

     (1)  Require the department of business, economic development, and tourism, in cooperation with the State's chief information officer, to:  

         (A)  Apply to the Internet Corporation of Assigned Names and Numbers for the domains .hawaii, .hi, and .aloha; and

         (B)  Develop a licensing procedure for approved vendors to use the domains .hawaii, .hi, and .aloha; and

     (2)  Appropriate funds for the application fee for the domains .hawaii, .hi, and .aloha and for the administrative costs of preparing the applications, maintenance of the domains, or any dispute resolution associated with the application.

     SECTION 2.  The department of business, economic development, and tourism shall apply to the Internet Corporation of Assigned Names and Numbers for the domains .hawaii, .hi, and .aloha.  The department shall also develop procedures to screen applicants who wish to use the .hawaii, .hi, and .aloha domains, and to grant licenses, upon payment of a licensing fee, to approved applicants.  The department may obtain guidance from the Internet Corporation of Assigned Names and Numbers with respect to the application and the development of procedures as provided in this section; provided that any licensing fees obtained by the State shall be deposited to the credit of the general fund.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $1,050,000 or so much thereof as may be necessary for fiscal year 2011-2012 to apply to the Internet Corporation of Assigned Names and Numbers for the domains .hawaii, .hi, and .aloha and for the administrative costs of preparing and filing the applications, maintenance of the domains, or any dispute resolution associated with the applications.

     The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.

     SECTION 4.  This Act shall take effect upon its approval.
