A BILL FOR AN ACT

 

 

RELATING TO NEPOTISM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 84, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§84-    Nepotism.  (a)  No legislator or employee shall advocate for, appoint, employ, promote, supervise, or advance to public office or employment any relative who is the legislator's or employee's spouse, reciprocal beneficiary, parent, son, daughter, brother, sister, uncle, aunt, first cousin, nephew, niece, grandparent, grandchild, father-in-law, mother-in-law, son-in-law, daughter-in-law, brother-in-law, sister-in-law, stepparent, stepson, stepdaughter, stepbrother, stepsister, half brother, or half sister.

     (b)  This section shall not apply in the event of an emergency resulting from a natural disaster or similar unforeseen event or circumstance.  In the event of an emergency resulting from a natural disaster or similar unforeseen event or circumstance, the director of human resources development may prescribe rules for executive departments to authorize the temporary employment of individuals whose employment would otherwise be prohibited under this section.  The administrative director of the courts may prescribe rules for the judiciary to authorize the temporary employment of individuals whose employment would otherwise be prohibited under this section.  The senate president and speaker of the house of representatives may prescribe rules for each respective house of the legislature for the temporary employment of individuals whose employment would otherwise be prohibited under this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.

Description:

Prohibits a legislator or public official from advocating for, appointing, employing, promoting, supervising, or advancing any relative to public office or employment.  Allows the director of human resources development, administrative director of the courts, and senate president and speaker of the house of representatives to prescribe rules for the temporary employment of relatives in the event of any emergency resulting from a natural disaster or similar unforeseen event or circumstance.  Effective 07/01/50.  (SD1)
