A BILL FOR AN ACT

 

 

relating to the attorney general.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 28, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§28-    Review of criminal investigations conducted by county police or county prosecuting attorneys.  (a)  The attorney general, upon referral by the county police or county prosecuting attorney, shall review or initiate a review of a criminal investigation conducted by the county police or county prosecuting attorney for the purpose of providing an independent review of such criminal investigations.

     (b)  In the course of the review, the attorney general may refer the review of the criminal investigation to, as applicable:

     (1)  A county police department of a county other than the county police that conducted the criminal investigation;

     (2)  A county prosecuting attorney of a county other than the county prosecuting attorney that conducted the criminal investigation; or

     (3)  The United States Attorney for the District of Hawaii.

     (c)  A review of a criminal investigation pursuant to this section shall be referred to or initiated by the attorney general no more than       days after the final disposition of the criminal investigation conducted by the county police or county prosecuting attorney.  The attorney general or party referred pursuant to subsection (b), as applicable, shall have no more than       days to complete the review of the criminal investigation.

     (d)  Completed reviews of criminal investigations conducted by the attorney general or party referred pursuant to subsection (b), as applicable, shall be received by the county police or county prosecuting attorney, as applicable, no later than       days after completion of the review.  The review shall be final."

     SECTION 2.  New statutory material is underscored.


     SECTION 3.  This Act shall take effect upon its approval.
