A BILL FOR AN ACT
relating to wildfire-AFFECTED AREAS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
"§127A-
Wildfire-affected areas; prohibitions;
safe entry. (a)
No person shall enter a wildfire-affected area for the purpose of
habitation until the department of health provides public notice, in the manner
prescribed in section 1‑28.5, that the wildfire-affected area is safe to
enter for this purpose.
(b) As used in this section,
"wildfire-affected area" means a specific area that was affected by a
wildfire that:
(1) Has been designated as toxic by the
United States Environmental Protection Agency; and
(2) Is subject to a debris removal
program, including any multi-phase program, to remove hazardous materials and
other fire debris,
and was subsequently closed to the public due
to safety hazards."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
