A BILL FOR AN ACT
relating to devices with monetary payouts.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The Hawaii Revised Statutes is amended by adding a new chapter to Title 26 to be appropriately designated and to read as follows:
"Chapter
Devices with Monetary payouts
§ -1 Prohibition of devices with monetary payouts in commercial establishments. (a) Any device that allows for a monetary payout that may be less than, equal to, or greater than the value of any coin, token, or currency inserted into the device as part of a single transaction is prohibited in any commercial establishment.
(b) This section shall not apply to monetary payouts that are refunds of purchases.
(c) For purposes of this section:
"Device" means any machine or mechanism that:
(1) Accepts coins, currency, or tokens; and
(2) Dispenses:
(A) Coins or currency; or
(B) Scrips, tickets, or tokens that may be redeemed for coins or currency;
provided that the term does not apply to change machines or vending machines that in their normal operation do not dispense more cash than was inserted for any single transaction or to any automated teller machine.
"Monetary payout" means coins or currency dispensed as a result of a transaction and includes scrips, tickets, or tokens that may be redeemed for coins or currency. The term does not include scrips, tickets, or tokens that can only be redeemed for merchandise or playing time on games, unless the merchandise or playing time may also be redeemed for coins or currency.
"Transaction" means a sequence of events initiated by inserting one or more coins or tokens or any currency into a device and culminating in a monetary payout.
(d) The owner of a commercial establishment shall be fined $2,500 for each device that is located at the establishment and in violation of this section. The attorney general may bring a civil action to enforce this section."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. This Act shall take effect upon its approval.
