A BILL FOR AN ACT

 

 

making an appropriation to the department of education for the new high school in kihei.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that south Maui County currently lacks a high school.  Significant population growth in this area, particularly in the Kihei-Makena region, along with geographical separation from existing central Maui high schools, has created a need for a new high school in south Maui.  Students in Kihei must travel long distances to attend high school in central Maui.  Furthermore, the lack of a high school in the south Maui area has raised enrollment at two central Maui schools, Maui high school and Baldwin high school, such that each of those schools has surpassed its respective design capacity and is now overcrowded.

     The legislature also finds that it has previously appropriated funds to cover all costs for the planning, design, and construction of a new high school in Kihei.  In 2013, the legislature appropriated $130,000,000 for the completion of the project.  However, due to fiscal concerns and changes in administration, the department of education was unable to spend $100,000,000 of the appropriated funds.  In response, the department adopted a phased approach for the project.  The first phase of the project would include the necessary infrastructure construction and the second phase would include the construction of the new school's physical buildings.

     The legislature additionally finds that it has secured $30,000,000 in funds for the first phase of the project.  The securing of these funds allowed the department to commence the infrastructure construction of the first phase and break ground on the new Kihei high school in January 2016.

     The legislature further finds that an appropriation of funds for the second phase of the Kihei high school project is necessary at this time so that the remaining planning, design, and construction work on the second phase may move forward without further delay.  While the design of this unique school has taken some additional time, the school's well-planned and strategic innovations will optimize the benefits provided to students and the community.  When complete, the new high school will feature an innovative, eco-friendly design that will take full advantage of the building site and accompanying natural resources.  The new school is designed as the first net-zero energy school in the State and it will incorporate site-appropriate eco-strategies that will allow for continuous use of indoor and outdoor learning spaces.

     The legislature also finds that the new Kihei high school project has been in the planning stages for nearly a decade and current estimates from the department of education indicate that the new school will not open before 2022.  Given the overcrowding in central Maui schools and the ever-increasing population in the Kihei-Makena region, additional delays in construction of the new Kihei high school will continue to negatively impact students and community members of south Maui.

     Accordingly, the purpose of this Act is to authorize the appropriation of $123,000,000 for the funding of the second phase of the planning, design, and construction of the new high school in Kihei, Maui.

SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $123,000,000 or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 for the department of education for completing the planning, design, and construction for the second phase of the new high school in Kihei, Maui.

The sums appropriated shall be expended by the department of education for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2017.
