A BILL FOR AN ACT
RELATING TO THE OFFICE OF PLANNING.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that Hawaii's clean energy initiative is admirable and worthy of our best efforts to achieve one hundred per cent renewable energy by 2045. The legislature also finds that fulfilling these ambitious goals will necessitate intensive land usage across the State, increasing the potential for public controversy.
In 2019, more than two hundred residents were arrested for protesting the delivery of turbine components to Na Pua Makani wind energy project in Kahuku. The controversial project is vehemently opposed by the host community, primarily because of the massive five hundred sixty-eight foot turbines and proximity to residences and schools, which is as close as 1,645 feet.
The legislature further finds that careful planning and public input will help minimize disruption of future renewable energy projects. Without such a plan, future renewable energy projects will likely face fierce opposition and the clean energy initiative goal itself could be jeopardized.
The Hawaii state energy office has developed two powerful, dynamic data visualization programs, Hawaii advanced visualization environment nexus and Hawaii energy visualization initiative, to better understand land use impacts and technical requirements of moving Hawaii toward its clean energy goals. These valuable tools can be used to support a proactive review of land availability and need for each of the renewable energy technologies by the office of planning and land use commission.
Accordingly, the purpose of this Act is to create a renewable energy siting plan that identifies appropriate lands needed to achieve each benchmark of the Hawaii clean energy initiative.
SECTION 2. (a) The office of planning shall prepare a comprehensive renewable energy siting plan, in consultation with the office of energy, land use commission, planning departments of each county, electric utilities, and with public input.
(b) The plan shall provide an inventory of suitable land for each of the renewable energy technologies on each of the islands, the estimated land requirements to produce various amounts of renewable energy, and multiple scenarios of land requirements to provide renewable energy in amounts sufficient to meet the benchmarks of the clean energy initiative.
(c) The office of planning shall submit a report on
its utility-scale renewable energy siting plan to the legislature no later than
twenty days prior to the convening of the regular session of 2022.
(d) For the purposes of this section, "renewable energy" has the same meaning as defined under section 269-91, Hawaii Revised Statutes.
SECTION 3. This Act shall take effect upon its approval.
