A BILL FOR AN ACT

 

 

relating to EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§302A‑    Teachers; evaluation period.  (a)  All newly hired teachers who are employed in teaching positions at public schools, as defined in section 302A‑101, shall be subject to an evaluation period of not less than four consecutive semesters.  All tenured and non-tenured teachers who transfer from one public school to another public school, regardless of whether either public school is a charter school, shall be subject to an evaluation period of not less than two semesters beginning on the date of transfer to the receiving school.

     (b)  During the evaluation period, the school principal of the newly hired or newly transferred teacher, as appropriate, shall evaluate the teacher on criteria to be determined by the Hawaii teacher standards board.  The evaluation shall be submitted by the appropriate school principal to the Hawaii teacher standards board for consideration in determining renewal, revocation, suspension, or reinstatement of that teacher's license.  The evaluation period shall be separate from any probationary period required by law or under collective bargaining agreements pursuant to chapter 89 for the purposes of satisfying tenure or other requirements.

     (c)  The board shall adopt rules, pursuant to chapter 91, to implement this section."

     SECTION 2.  Section 302B-10, Hawaii Revised Statutes, is amended by amending subsection (d) to read as follows:

     "(d)  The department, in conjunction with the office, shall facilitate and encourage the movement of instructional personnel between the department and charter schools; provided that:

     (1)  Comparable and verifiable professional development and employee evaluation standards and practices, as determined and certified by the office, are in place in charter schools for instructional staff;

     (2)  Licensed charter school teachers, as determined by the Hawaii teacher standards board, who are not yet tenured in the department and are entering or returning to the department after full-time employment of no less than one full school year at a charter school, shall be subject to no more than one year of probationary status; [and]

     (3)  Tenured department licensed teachers, as determined by the department, who transfer to charter schools shall not be required to serve a probationary period[.]; and

     (4)  Tenured and non-tenured teachers who are newly hired by or transferred to charter schools shall be subject to an evaluation period, pursuant to section 302A‑  ."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
