A BILL FOR AN ACT
RELATING TO EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is protect the health, safety, and well-being of children following the occurrence of situations that may have caused physical, psychological, or emotional harm to children during a school activity. The intent of the legislature is to ensure that when these situations occur, school employees or administrators provide an appropriate response that separates personnel and privacy issues from adequate attention to the health, safety, and well-being of children.
SECTION 2. Chapter 302A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§302A‑ Potentially harmful situations. (a) After the occurrence of a situation that may have caused physical, psychological, or emotional harm to a child during a school activity, the appropriate teachers, educational officers, and school administrators shall:
(1) Carefully consider the health, safety, and well-being of any child involved in the situation in addition to other considerations, including personnel matters; and
(2) Provide as much information as an appropriate school authority deems necessary to parents, guardians, children, and staff, as appropriate, to prevent or mitigate harm to the child or children as a result of the situation.
(b) The department shall provide training to all teachers, educational officers, and school administrators on the proper procedures under applicable laws and department rules and regulations for communicating the information deemed necessary pursuant to subsection (a)."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2050.
