A BILL FOR AN ACT

 

 

RELATING TO THE PACIFIC INTERNATIONAL SPACE CENTER FOR EXPLORATION SYSTEMS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  Chapter 201, part V, Hawaii Revised Statutes, is amended by adding four new sections to be appropriately designated and to read as follows:

     "§201-     Definitions.  As used in this part:

     "Board of directors" means the board of directors of the office of aerospace and aviation industries.

     §201-     Hawaii unmanned aerial systems test site advisory board; established.  (a)  There is established a Hawaii unmanned aerial systems test site advisory board, as a subcommittee of the board of directors, to oversee the planning, economic development, job creation, and operation of the Hawaii unmanned aerial systems test site.

     (b)  The advisory board shall be composed of seven members as follows:

     (1)  The adjutant general, or the adjutant general's designee;

     (2)  The director of transportation, or the director's designee;

     (3)  The director of business, economic development, and tourism, or the director's designee;

     (4)  The president of the University of Hawaii, or the president's designee;

     (5)  One member representing the Hawaii business community, to be appointed by the governor pursuant to section 26-34; and

     (6)  Two members representing the aerospace or aviation industries, to be appointed by the governor pursuant to section 26-34.

     Each advisory board member shall serve for a term of four years; provided that the initial terms shall be staggered, as determined by the governor.

     (c)  Members of the advisory board shall not receive compensation for their services but shall be reimbursed for necessary expenses, including travel expenses, incurred in the performance of their duties under this section.

     §201-    Hawaii unmanned aerial systems test site chief operating officer.  (a)  The department of business, economic development, and tourism shall hire a chief operating officer who shall manage the operations of the Hawaii unmanned aerial systems test site.  The chief operating officer shall:

     (1)  Monitor, oversee, and recommend operations of unmanned aerial systems test site activities;

     (2)  Facilitate opportunities for public and private use of unmanned aerial systems test site facilities;

     (3)  Assist unmanned aerial systems test ranges;

     (4)  Leverage aerospace and related technological capabilities in the State's academic, public, and private sectors to support testing and evaluation at Hawaii's unmanned aerial systems test ranges;

     (5)  Promote innovative education, economic opportunities, job creation, and workforce development programs to enhance public awareness of the benefits and opportunities that unmanned aerial systems technologies and applications can bring to the State;

     (6)  Monitor national and global trends in unmanned aerial systems development and testing, and recommend policies and programs to advance unmanned aerial systems testing in Hawaii;

     (7)  Establish and maintain a public website with updated information on the program and provide information on the Hawaii unmanned aerial systems test site initiative;

     (8)  Contract for services and implement agreements, subject to chapter 103D, as may be necessary to conduct operations at Hawaii's unmanned aerial systems test ranges;

     (9)  Serve as Hawaii's representative on the Pan-Pacific Unmanned Aerial Systems Test Range Complex management team; and

    (10)  Submit an annual report to the legislature no later than twenty days prior to the convening of each regular session, which shall include the status of work, expenditures, and trends regarding the Hawaii unmanned aerial systems test site.

     (b)  The chief operating officer may employ one administrative assistant for the Hawaii unmanned aerial systems test site operations and activities.

     §201-     Space vehicles; prohibitions.  Any vehicle launched into space from the land or ocean territory of the State shall not carry weapons of destruction, nuclear waste materials, or use radioactive materials as a power source."

PART II

     SECTION 2.  Chapter 201, part V, Hawaii Revised Statutes, is amended by amending its title to read as follows:

     "PART V.  OFFICE OF AEROSPACE [DEVELOPMENT] AND AVIATION INDUSTRIES"

     SECTION 3.  Section 201-76, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is established the [Pacific international space center for exploration systems,] office of aerospace and aviation industries, to be [administratively] attached to[the office of aerospace development in] the department of business, economic development, and tourism[.] for administrative purposes only."

     SECTION 4.  Section 201-77, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  There is established the board of directors of the [Pacific international space center for exploration systems,] office of aerospace and aviation industries, consisting of nine members, to include:

    [(1)  The executive director of the space center as an ex officio, voting member;

     (2)] (1)  The director of business, economic development, and tourism, or the director's designated representative;

    [(3)] (2)  The president of the University of Hawaii[,] and the chancellor of the University of Hawaii at Hilo, or [the president's] their designated [representative;] representatives; and

    [(4)] (3)  Six members from government, industry, and academia, both national and international, with appropriate professional interests and backgrounds, to be appointed by the governor, pursuant to section 26-34; provided that of the members appointed under this paragraph [(4)], two members shall be appointed from a list of nominees submitted by the president of the senate, two members shall be appointed from a list of nominees submitted by the speaker of the house of representatives, and two members shall be appointed by the governor.

     The board shall select a chairperson from among its members."

     SECTION 5.  Section 201-78, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  In addition to other powers conferred upon it, the board may do all things necessary and convenient to carry out the powers expressly provided in this [subpart.] part."

     SECTION 6.  Section 201-79, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§201-79[]]  Powers and duties of the [Pacific international space center for exploration systems] office of aerospace and aviation industries executive director.  In addition to any other powers and duties provided in this [subpart,] part, the executive director shall:

     (1)  [Oversee, supervise, and direct the planning, evaluation, and coordination of space-related activities, and identify and promote opportunities for expanding and diversifying aerospace-related industries in the State pertaining to the space center;] Plan, evaluate, and coordinate economic opportunities and job creation for space-related research activities through the office of aerospace and aviation industries;

     (2)  Establish partnerships with corporate, government, and University of Hawaii entities that can promote and enhance the State's aerospace [industry; and where possible, help to generate additional revenue for the University of Hawaii and create classes and other educational opportunities for students;] research;

     (3)  Work with local universities and community colleges to facilitate internships for students with the [space center] office of aerospace and aviation industries and associated companies;

    [(4)  Continue to work with the University of Hawaii on course development, teaching, workforce development, and outreach;

     (5)  Promote innovative educational and workforce development programs that will enhance public awareness of the space center and enable residents to pursue employment in Hawaii's aerospace industry;

     (6)  Act as the public representative of the space center;]

     (4)  Promote innovative educational and workforce development programs that will enable residents to pursue employment in Hawaii's aerospace industry;

    [(7)] (5)  Monitor [national and global] trends in [the] aerospace [industry] research and promote global awareness of the [space center;] office of aerospace and aviation industries;

    [(8)  Pursue projects in the aerospace sector that can be leveraged for improvements to the State's broadband and alternative energy capabilities;

     (9)  Serve as a clearinghouse for information on the space center and associated activities;

    (10)  Target existing businesses that can provide products or services of importance to the space center and its projects to support the expansion of these businesses in Hawaii;]

     (6)  Target research to support existing businesses that can provide products or services of important to the office of aerospace and aviation industries and its projects to support the expansion of these businesses in Hawaii;

   [(11)] (7) [Increase contact and maintain liaison] Maintain contact with the National Aeronautics and Space Administration, related aerospace organizations, and other federal agencies and facilities;

   [(12)] (8)  Maintain and expand liaisons with local business and citizen groups;

   [(13)] (9)  Work with private landowners in the vicinity to expand opportunities [and physical space and appurtenances] for the participants in the [space center's] office of aerospace and aviation industries' aerospace technology research and development [park;] programs;

   [(14)  Adopt, amend, and repeal rules pursuant to chapter 91 necessary to carry out this subpart;]

   [(15)] (10) Contract for services as may be necessary for the purposes of this [subpart;] part; and

   [(16)] (11) Do all other things necessary or proper to carry out the purposes of this [subpart.] part."

     SECTION 7.  Section 201-80.2, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  All moneys in excess of $1,000,000 remaining in the [Pacific international space center for exploration systems] office of aerospace and aviation industries special fund at the close of each fiscal year that are deemed, by the director of finance, to be in excess of the moneys necessary to carry out the purposes of this section in the next fiscal year shall lapse to the credit of the state general fund."

PART III

     SECTION 8.  Section 201, Hawaii Revised Statutes, is amended by repealing the title of part V, subpart B.

"[B.  Pacific International Space Center for

 Exploration Systems]"

     SECTION 9.  Chapter 201, part V, subpart A, Hawaii Revised Statutes, is repealed.

     SECTION 10.  All rights, powers, functions, and duties of the office of aerospace development are transferred to the office of aerospace and aviation industries.

     All employees who occupy civil service positions and whose functions are transferred to the office of aerospace and aviation industries by this Act shall retain their civil service status, whether permanent or temporary.  Employees shall be transferred without loss of salary, seniority (except as prescribed by applicable collective bargaining agreements), retention points, prior service credit, any vacation and sick leave credits previously earned, and other rights, benefits, and privileges, in accordance with state personnel laws and this Act; provided that the employees possess the minimum qualifications and public employment requirements for the class or position to which transferred or appointed, as applicable; provided further that subsequent changes in status may be made pursuant to applicable civil service and compensation laws.

     Any employee who, prior to this Act, is exempt from civil service and is transferred as a consequence of this Act may retain the employee's exempt status, but shall not be appointed to a civil service position as a consequence of this Act.  An exempt employee who is transferred by this Act shall not suffer any loss of prior service credit, vacation or sick leave credits previously earned, or other employee benefits or privileges as a consequence of this Act; provided that the employees possess legal and public employment requirements for the position to which transferred or appointed, as applicable; provided further that subsequent changes in status may be made pursuant to applicable employment and compensation laws.  The chairperson of the board of directors of the office of aerospace and aviation industries may prescribe the duties and qualifications of these employees and fix their salaries without regard to chapter 76, Hawaii Revised Statutes.

     SECTION 11.  All rules, policies, procedures, guidelines, and other material adopted or developed by the office of aerospace development to implement provisions of the Hawaii Revised Statutes that are reenacted or made applicable to the office of aerospace and aviation industries by this Act shall remain in full force and effect until amended or repealed by the office of aerospace and aviation industries pursuant to chapter 91, Hawaii Revised Statutes.  In the interim, every reference to the office of aerospace development and aerospace advisory committee in those rules, policies, procedures, guidelines, and other material is amended to refer to the office of aerospace and aviation industries or the board of directors of the office of aerospace and aviation industries, as appropriate.

     SECTION 12.  All deeds, leases, contracts, loans, agreements, permits, or other documents executed or entered into by or on behalf of the office of aerospace development, pursuant to the provisions of the Hawaii Revised Statutes that are reenacted or made applicable to the office of aerospace and aviation industries by this Act shall remain in full force and effect.  Effective July 1, 2018, every reference to the office of aerospace development or the aerospace advisory committee in those deeds, leases, contracts, loans, agreements, permits, or other documents shall be construed as a reference to the office of aerospace and aviation industries or the board of directors of the office of aerospace and aviation industries, respectively.

     SECTION 13.  All appropriations, records, equipment, machines, files, supplies, contracts, books, papers, documents, maps, and other personal property heretofore made, used, acquired, or held by the office of aerospace development relating to the functions transferred to the office of aerospace and aviation industries shall be transferred with the functions to which they relate.

     SECTION 14.  Chapter 201, Hawaii Revised Statutes, is amended by substituting the name "office of aerospace and aviation industries" wherever the name "Pacific international space center for exploration systems" appears, as the context requires.

     SECTION 15.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 16.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 17.  This Act shall take effect on July 1, 2050.


 


 

Report Title:

Pacific International Space Center for Exploration Systems; Office of Aerospace Development; Office of Aerospace and Aviation Industries; Office of Aerospace and Aviation Industries Special Fund Ceiling

 

Description:

Renames the Pacific International Space Center for Exploration Systems (PISCES) as the Office of Aerospace and Aviation Industries.  Amends section 201-76, Hawaii Revised Statutes, to attach the Office of Aerospace and Aviation Industries to the Department of Business, Economic Development, and Tourism.  Deletes the executive director of PISCES as a member of the Office of Aerospace and Aviation Industries board of directors and adds the Chancellor of the University of Hawaii at Hilo.  Establishes a ceiling of $1,000,000 for the Office of Aerospace and Aviation Industries special fund.  Repeals the office of aerospace development and transfers all rights, powers, functions, and duties to the Office of Aerospace and Aviation Industries.  Effective 7/1/2050.  (SD2)
