2744

THIRTY-SECOND LEGISLATURE, 2024

STATE OF HAWAII

A BILL FOR AN ACT

relating to vehicles.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1.  The legislature finds that public safety is a top priority for the State.  Therefore, the legislature believes that pedestrians crossing the street must be visible to drivers.  The legislature notes that other states have begun to prohibit the parking of vehicles near crosswalks to improve pedestrian visibility.

Accordingly, the purpose of this Act is to prohibit any person from parking a vehicle or constructing or installing any parking stall abutting the curb or edge of vehicle travel way within twenty feet of a marked crosswalk on a public right of way along a road or highway.

SECTION 2.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XI to be appropriately designated and to read as follows:

"§291C-     Parking near crosswalks; prohibited.  (a)  No person shall park any vehicle or construct or install any parking stall abutting the curb or edge of vehicle travel way within twenty feet of a marked crosswalk on a public right of way along a road or highway."

SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 4.  New statutory material is underscored.

SECTION 5.  This Act shall take effect upon its approval.
