A BILL FOR AN ACT
RELATING TO PUBLIC AUCTIONS.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 141, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§141- Disposition
of public lands by public auction; requirements. (a)
The disposition of any public lands under
the jurisdiction of the board or department by public auction shall be open to the
public.
(b) The
board or department, as applicable, shall issue a public advertisement in accordance
with section 1-28.5 for each public auction to dispose of public lands under the
jurisdiction of the board or department.
(c) This section shall only apply to the disposition
of public lands for new leases. This section
shall not apply to the renegotiation of existing leases on public lands."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.

Description:
Requires the disposition for new leases of any public lands under the jurisdiction of the Board of Agriculture or Department of Agriculture by public auction to be open to the public. Requires the Board of Agriculture or Department of Agriculture, as applicable, to issue public advertisements for each public auction. (SD1)
