A BILL FOR AN ACT

 

 

Relating to Warning Signs.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 281-44, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  All licensed premises shall post a sign in or about the premises [containing and notifying].  The sign shall:

     (1)  Contain and notify all customers and other persons of the possible sanctions that may be imposed for operating a vehicle under the influence of an intoxicant under sections 291E-41 and 291E-61[.]; and

     (2)  Bear the following statement:

          "WARNING:  Women should not drink alcoholic beverages during pregnancy because of the risk of birth defects and fetal alcohol spectrum disorders.  Conditions associated with fetal alcohol spectrum disorders include physical, mental, behavioral, and learning disabilities."

The sign shall be conspicuously positioned in order to be seen by an ordinarily observant person.  The statement required by paragraph (2) of this subsection shall be in type of a size determined by the comptroller, and shall appear on a contrasting background."

     SECTION 2.  The comptroller shall determine the size of the type required pursuant to section 1 of this Act on or before August 1, 2012.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2013; provided that section 2 shall take effect upon its approval.

Description:

Requires premises licensed under chapter 281, Hawaii Revised Statutes, to have an advertisement or sign posted on or about the premises that provides customers with a warning that women should not drink alcoholic beverages during pregnancy.  Effective January 1, 2013.
