A BILL FOR AN ACT

 

 

Related to public parks.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Limitations.  No county shall prohibit leashed dogs in public parks."

     SECTION 2.  Chapter 339, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§339-    Dog excrement; prohibition; penalties.  (a)  No person shall leave dog excrement on any public or private property or in any public or private waters, except:

     (1)  In a place designated by the department of health or the county for the disposal of garbage, dog excrement, and refuse;

     (2)  Into a litter receptable; or

     (3)  Into a bag; provided that the bag is disposed of properly into a litter receptable or in a place designated by the department of health or the county for the disposal of garbage, dog excrement, and refuse.

     (b)  Any person violating this section shall be guilty of a violation, and shall be fined not less than $100, and not more than $500 for each offense, and ordered to pick up and remove litter from a public place under the supervision of the director as follows:

     (1)  For the first offense, the defendant shall spend four hours either picking up litter on public property or performing community service; and

     (2)  For any subsequent offense, the defendant shall spend eight hours either picking up litter on public property or performing community service.

     (c)  If the environmental court judges the violator to be incapable of litter removal and pick up, the environmental court may provide some other community work as it deems appropriate.  All persons in violation shall remove the excrement or shall be liable for the costs of removing the excrement."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
