A BILL FOR AN ACT

 

 

relating to Health.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the artificial sweetener aspartame has been the subject of several controversies since the federal Food and Drug Administration first approved it in 1981.  The legislature also finds that complaints of various health issues, including brain cancer and birth defects, have been associated with consumption of high levels of aspartame.

     The purpose of this Act is to require a product warning label on all food products containing aspartame that are offered for sale or distribution in the State.

     SECTION 2.  Chapter 328, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§328-    Regulation of products containing aspartame.  The sale or distribution in the State of any product containing aspartame is prohibited unless the product label contains the following statement:  "This product contains aspartame, which may cause brain cancer and birth defects in pregnant women.""

     SECTION 3.  Section 328-1, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

     ""Aspartame" has the same meaning as in 21 Code of Federal Regulations 172.804."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
