A BILL FOR AN ACT

 

 

RELATING TO INVASIVE SPECIES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  Chapter 194, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§194-    Invasive species list amendment.  Without regard to the notice and public hearing requirements of chapter 91, the council may adopt rules to make additions to or deletions from the list identifying invasive species present in the State required by section 194-2(a)(6); provided that the council shall adopt rules pursuant to chapter 91 to establish methods to obtain public input and notify the public of additions to or deletions from the list identifying invasive species present in the State required by section 194-2(a)(6); provided further than the list shall not include any domesticated pet species."

     SECTION 2.  Section 194-5, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  Whenever any invasive species identified by the council for control or eradication is found on private property, a department or its agent may enter [such] the affected premises to control or eradicate the invasive species after reasonable notice is given to the owner of the property and, if entry is refused, pursuant to the court order in subsection (d)."

PART II

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2016-2017 to the department of land and natural resources division of forestry and wildlife for the immediate, coordinated management of albizia trees that threaten access to critical emergency services and transportation routes identified by the Hawaii county civil defense agency for the island of Hawaii, as follows:

     (1)  The funds shall be expended solely for the coordinated management of albizia trees on the island of Hawaii, except that other plants may be incidentally removed in the process.  If the project cannot be continued, funds may be transferred to another island invasive species committee to accomplish the same purpose on that island;

     (2)  Albizia trees shall be completely removed from highway rights of way, and albizia trees outside the right of way that are deemed non-hazardous shall be treated and left in place; and

     (3)  Control of albizia trees shall be concentrated in the following areas:

         (A)  The two-mile stretch of highway 132 between Lava Tree state park and Pahoa;

         (B)  Isolated patches of albizia trees between Kalapana and Pahoa;

         (C)  Isolated patches of albizia trees between Pahoa and Keaau;

         (D)  The hospital corridor, particularly the segment of Waianuenue avenue from Komohana street to Akolea road, the segment of Akolea road from Waianuenue avenue to Kaumana drive, and Puainako street from highway 11 to Kaumana drive; and

         (E)  Any additional areas of the island of Hawaii as deemed necessary by the Big Island invasive species committee.

     The sum appropriated shall be expended by the department of land and natural resources division of forestry and wildlife for use by the Big Island invasive species committee for the purposes of this Act.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval; provided that section 3 of this Act shall take effect on July 1, 2016.

Hawaii Invasive Species Council; Invasive Species; Entering Private Property; Albizia; Appropriation

 

Description:

Authorizes HISC to adopt rules to change its invasive species list.  Prohibits the inclusion of domesticated pet species on the invasive species list.  Authorizes an agent of HISC to enter affected premises on private property, under specific conditions, to control or eradicate invasive species.  Makes an appropriation to the department of land and natural resources division of forestry and wildlife for use by the Big Island invasive species committee for the immediate coordinated management of albizia trees on the island of Hawaii.  (SD1)
