A BILL FOR AN ACT

 

 

relating to capital improvement projects.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The recession of 2008 posed enormous challenges for governments at all levels.  Its effects are still being felt today, including a profound impact on Hawaii's businesses and employment rates.  Capital improvement projects are a potential catalyst for fostering economic growth and development within the State.  However, county permitting processes have delayed many of the State's projects that are ready to break ground.

     The purpose of this Act is to:

     (1)  Exempt from county permitting requirements all state capital improvement projects for which funds are released in fiscal years 2012-2014; and

     (2)  Authorize the state director of finance to waive county permitting requirements for pending state capital improvement projects for which funds were released in fiscal years 2010-2012.

     SECTION 2.  All state capital improvement projects for which funds are released between July 1, 2012, and June 30, 2014, shall be exempt from county permits required by county law; provided that all projects exempted under this section shall adhere to the standards required by the applicable county permits.

     SECTION 3.  This Act shall not apply to permits required by state or federal law.

     SECTION 4.  The state director of finance may waive the applicable county permitting requirements for pending state capital improvement projects for which funds were released between July 1, 2010, and June 30, 2012; provided that the waiver shall be granted only for projects for which funds have not lapsed at the time of the waiver.

     SECTION 5.  This Act shall take effect on July 1, 2012.
