A BILL FOR AN ACT

 

 

relating to cooperative housing corporations.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Act 18, Session Laws of Hawaii 2012, authorized the installation of utility meters to measure utility use by individual units within a condominium, regardless of when the condominium project was constructed; provided that the condominium association bore the cost of installing the utility meters.  Separate utility metering requires individual residents to be financially responsible for their own energy use, which may help incentive owners to conserve energy.

     The legislature further finds that although Act 18 authorized separate metering of utilities in condominiums, it did not address separate metering of utilities in cooperative housing corporations.  For consistency, the ability to install utility meters to measure utility use by individual dwelling units should be extended to cooperative housing corporations.

     Accordingly, the purpose of this Act is to allow a board of directors of a cooperative housing corporation to authorize the installation of separate utility meters for each dwelling unit; provided that the corporation pays the cost of installing the meters.

     SECTION 2.  Chapter 421I, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§421I-    Metering of utilities.  Notwithstanding any provision to the contrary in a corporation's bylaws, the board of directors may authorize the installation of separate meters to determine the use by each dwelling unit of utilities, including electricity, water, gas, fuel, oil, sewerage, and drainage; provided that the cost of installing the meters shall be paid by the corporation."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
