A BILL FOR AN ACT

 

 

RELATING TO EDUCATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to authorize certain caregivers to execute an affidavit for caregiver consent on behalf of a minor to allow the minor to participate fully in programs and services of minors subject to the Individuals with Disabilities Education Act or section 504 of the Rehabilitation Act of 1973.

     SECTION 2.  Section 302A-482, Hawaii Revised Statutes, is amended by amending subsection (g) to read as follows:

     "(g)  This section shall [not] apply to the programs and services of minors subject to the Individuals with Disabilities Education Act (20 U.S.C. section 1400 et seq.) or section 504 of the Rehabilitation Act of 1973 (29 U.S.C. section 791)."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.


     SECTION 4.  This Act shall take effect upon its approval.
