A BILL FOR AN ACT
relating to prescription medication.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§346- Opioid dependency; treatment;
buprenorphine; coverage. (a) Prescription drug coverage provided under the
State's medicaid managed care and fee-for-service programs shall include
prescription drug coverage for buprenorphine, when used in the treatment of
opioid dependency.
(b) Buprenorphine prescriptions under this
section shall be exempt from any copayment requirements and any prior authorization
requirements.
(c) For the purposes of this section, "buprenorphine"
means a schedule III drug included in section 329-18, which is used in the
treatment of opioid dependency."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval; provided that section 1 shall take effect upon approval of the Hawaii medicaid state plan by the Centers for Medicare and Medicaid Services.
